CITY OF BANDERA
DECLARATION OF PUBLIC HEALTH EMERGENCY

WHEREAS, pursuant to Texas Government Code Section 418.108, the mayor of a municipality may declare a local state of disaster; and,

WHEREAS, the mayor of a municipality may order the evacuation of all or part of the population from a stricken or threatened area under the jurisdiction and authority of the mayor if the mayor 
considers the action necessary for the preservation of life; and, 

WHEREAS, the mayor of a municipality may control ingress to and egress from a disaster area under the jurisdiction and authority of the mayor and control the movement of persons and the occupancy of premises in that area; and,

WHEREAS, on August 4, 2023 it was determined that due to high water temperature, low water flow and bacteria levels within the Medina River accessible from the City Park, it was unsafe to allow public access to the water from the City Park

NOW, THEREFORE, A PUBLIC HEALTH EMERGENCY IS HEREBY DECLARED BY THE MAYOR OF THE CITY OF BANDERA:

1.    That a local state of disaster and public health emergency due to the high water temperature, low water flow and bacteria levels within the Medina River thereby necessitating prohibited access to the Medina River from the City Park is hereby declared for the City of Bandera pursuant to §418.108(a) of the Texas Government Code

2.   Pursuant to §418.108(b) of the Government Code, the state of disaster and public health emergency shall continue for a period of not more than seven days from the date of this declaration unless continued or renewed by the City Council.

3.   Pursuant to §418.108(c) of the Government Code, this declaration of a local state of disaster and public health emergency shall be given prompt and general publicity and shall be filed promptly with the City Secretary.

4.   Pursuant to §418.108(d) of the Government Code, this declaration of a local state of disaster and public health emergency activates the City of Bandera emergency management plan as necessary.

5.   The City Secretary is directed to give prompt and general publicity of the issuance of this DECLARATION and place same before the City Council for consideration for continuation at its next regular meeting.

6.   This proclamation shall take effect immediately from and after its issuance.

7.   A violation of the rules provided for in this declaration is a Class C misdemeanor punishable by a fine not to exceed $2,000.00.

8. As Mayor, I further reserve all other authority and powers conferred by state law to respond as necessary to this situation.
